GENERAL

The terms and conditions as set out herein (“Terms”) constitute an agreement between SavoMart (“SAVOMart”, “we”, “us” or “our”), which manages and operates the SAVOMart Platform (defined below) and any natural or legal person who accesses and/or uses SAVOMart Platform in any manner (“you” or “your”) or uses any current or future service or functionality or offer made available on SAVOMart Platform (“Service”), as updated from time to time.

SAVOMart encourages you to review the terms and condition periodically for any such changes. It is your responsibility to carefully read, agree with and accept the terms or any other terms and condition.

ACCOUNT AND REGISTRATION OBLIGATIONS

In order to access and place orders on the Company’s website (“Platform/site”), all customers are required to complete a one-time registration and create a user account using accurate, complete, and up-to-date information. It is your responsibility to maintain the confidentiality of your login credentials and to ensure that your account information remains accurate and current, including your delivery address, phone number, and email ID. The Company shall not be held liable for any delays, delivery failures, or communication issues arising from your failure to maintain accurate account details.

By registering on the Site, you expressly consent to receive transactional communications, promotional content, service-related alerts, newsletters, and marketing campaigns via email, SMS, or other digital media, subject to applicable law. You may opt out of such promotional communications at any time by accessing the unsubscribe option available in the “My Account” section or by contacting the Company’s customer service team. Please note that withdrawal of consent for promotional content shall not affect the delivery of service-related transactional messages necessary to complete your order or fulfil other contractual obligations.

PRICING

All products displayed on the Site shall be sold at their Maximum Retail Price (MRP), unless a discount or promotional offer is explicitly mentioned. The price applicable to your order will be the price as displayed and accepted at the time of placing the order, and no changes will be made based on price fluctuations that may occur between the time of order and the time of delivery. While most product prices remain consistent, the prices of certain items, particularly fresh produce, and perishable goods, are subject to fluctuations based on market conditions.

The Company endeavours to reflect current pricing as accurately as possible. However, in cases where the price at the time of delivery is higher or lower than that at the time of placing the order, the price charged will remain as originally displayed and accepted at checkout. No additional charges will be collected, and no refunds will be issued solely due to price variations occurring between the date of order and the date of delivery.

ORDER CANCELLATION – BY CUSTOMER OR SITE

As a registered customer, you may cancel your order without penalty any time before the scheduled cut-off time of the store or fulfilment location processing your order. Cancellations must be made by contacting our customer service helpline. In such cases, any pre-paid amount will be refunded in accordance with the Company’s refund policy.

The Company reserves the right, in its sole discretion, to cancel any order placed on the Site if it suspects a fraudulent transaction, misuse of services, violation of the Terms and Conditions of the Site, or abuse of promotional offers. In the event of such cancellation, the Company may retain a record of the concerned customer’s activity and take necessary measures to restrict or block their access to the Site, including placing the customer on a restricted list to prevent future misuse.

RETURN & REFUNDS

The Company follows a “no-questions-asked” return and refund policy at the time of delivery. If, for any reason, you are dissatisfied with the quality, condition, or freshness of any item delivered, you may return the item to our delivery executive immediately at the time of delivery. Such returns will be duly acknowledged, and the value of the returned items will be credited to your account in the form of a credit note or wallet balance on the Site.

The credit value can be applied toward the payment of your subsequent orders. Refunds or credits are not issued once the delivery has been accepted and acknowledged by you. The Company reserves the right to deny returns in cases of repeated misuse or in the absence of valid justification.

RESTRICTED USE OF THE SITE

You agree to use the Site in a lawful manner and in accordance with the Terms of Use and applicable Indian laws. You shall not use the Site for any of the following prohibited purposes:

1. >Uploading, distributing, or transmitting any content that is unlawful, defamatory, obscene, abusive, harassing, or otherwise objectionable;
2. >Disseminating material that incites criminal conduct, promotes civil liability, or violates any statute, regulation, or code of conduct;
3. >Attempting to gain unauthorized access to any part of the Site, its data, or other users’ accounts;
4. >Disrupting or interfering with another user’s access, enjoyment, or use of the Site;
5. >Violating any applicable laws, including those related to cybercrime, intellectual property, or data protection;
6. >Uploading or distributing any files that contain viruses, malware, spyware, or other harmful components;
7. >Reproducing, distributing, or transmitting any copyrighted materials without the express consent of the rightful owner.

The Company reserves the right to suspend or terminate access to the Site for any user found to be in breach of these restrictions, without notice and at its sole discretion.

PRODUCT REPRESENTATION – COLOURS AND IMAGES

The Company makes every effort to ensure that the images and descriptions of products displayed on the Site are as accurate and representative as possible. Product photographs and colours are captured in high resolution to reflect their actual appearance. However, due to variations in device screen settings, lighting conditions, and image processing, the colours you see on your screen may slightly differ from the actual product colour.

The Company does not guarantee that your device monitor will accurately reflect the true colour, texture, or appearance of the product. Product packaging, design, or labelling may also vary slightly due to changes by the manufacturer or supplier. Such differences shall not be considered a defect or grounds for return unless the product delivered is materially different from what was ordered.

ELIGIBILITY TO USE

By using this Site, you confirm that you are competent to contract under the Indian Contract Act, 1872, and are at least 18 years of age. If you are accessing the platform on behalf of a minor or any other person, you affirm that you are duly authorized to do so and that all actions taken under your account are binding upon such persons.

PRODUCT AVAILABILITY AND SUBSTITUTION

All products displayed on the Site are subject to availability. In the event that an item ordered by you is out of stock or unavailable, the Company reserves the right to cancel the item from your order or substitute it. In such cases, you will be notified at the time of delivery or via your registered communication channel.

DELIVERY TERMS AND CONDITIONS

Delivery timelines provided on the Site are indicative and not binding. The Company will make all reasonable efforts to deliver the order within the estimated time; however, delays may occur due to unforeseen circumstances.

INTELLECTUAL PROPERTY RIGHTS

All content on the Site, including but not limited to product images, text, graphics, logos, button icons, audio clips, digital downloads, data compilations, and software, is the property of the Company or its content suppliers and is protected by applicable intellectual property laws. Unauthorized use, reproduction, or distribution of any content without prior written consent is strictly prohibited.

FEEDBACK AND REVIEWS

You may voluntarily submit reviews, feedback, or ratings on products or services. By doing so, you grant the Company an irrevocable, non-exclusive, royalty-free license to use, reproduce, and publish such content. The Company reserves the right to moderate, remove, or refuse to publish content that it deems offensive, defamatory, misleading, or in violation of applicable laws.
